Hunter Biden Loophole

Have you heard of the Hunter Biden Loophole? It’s when you’re against all sensible gun regulations except the one that gets Hunter Biden indicted. It’s a loophole that allows gun-loving fascist MAGA goons who care more about their right to own a bazooka than the lives of children in elementary schools who get gunned down by a lunatic who purchased his assault rifle legally to be hypocrites.

Think of it like the Gun Show Loophole that allows “private” gun sellers to sell guns to individuals without a background check. Yes, this is legal in multiple states.

But the charges against President Joe Biden’s son are weird. Sure, if Hunter is a lawbreaker, then go and get him. I don’t care about Hunter, but I do care about consistency and fairness. Going after someone for five years for lying on a form, striking a plea deal, canceling the plea deal, then prosecuting, IS NOT FAIR.

Federal prosecutors have brought three gun charges against Hunter Biden that can land him in prison for up to 25 years and levy a fine of $750,000. Hunter is a first-time, nonviolent offender accused of lying on a federal firearms application, who never used the gun (in his case, a Colt Cobra .38 that he held onto for less than two weeks five years ago) to commit a crime. So what are the three charges?

A federal grand jury in Wilmington, Delaware, charged Hunter with three felonies: lying to a federally licensed gun dealer, which carries a maximum penalty of 10 years in jail; making a false claim on the federal firearms application used to screen applicants, with a sentence of up to five years; and possession of an illegally obtained gun from Oct. 12 to Oct. 23, 2018, which carries a maximum of 10 years.

When Hunter bought the gun he had for less than two weeks, he had to fill out a form for a federal background check. In response to a question on the form about whether he was using drugs, Hunter said he was not, an assertion that prosecutors claim was false.

Most people accused of lying on a federal firearms application, like Hunter has been, are not indicted on that charge unless they are also accused of a more serious underlying crime. These charges are usually brought against convicted felons who illegally possess a gun or who commit a violent or drug-related charge. It would think that if prosecutors get convictions on all three charges, the judge would punish Hunter with a fine and probation since he’s a first-time offender, except the judge, in this case, could be a Trump-appointed judge.

Hunter had a plea agreement with the prosecutor, David Weiss, a Trump appointee, who agreed that the Justice Department would not prosecute Hunter over the handgun purchase, contingent on him remaining drug-free for 24 months and never owning a firearm again. Then a Trump-appointed judge threw out the deal. Then, Attorney Merrick Garland appointed the Trump-appointed prosecutor, who had made that deal, to Special Counsel. Now, the Special Counsel, who originally made that deal not to prosecute Hunter is prosecuting Hunter.

Maybe David Weiss and Merrick Garland don’t really care about Hunter and are just doing this to shut up Republicans, but it’s an abuse of their offices. And nothing shuts up Republicans.

Remember, this investigation began during the Trump president (sic) over five years ago. Does something not smell right?

Here’s where gun nuts get to be hypocrites. Denying a former drug addict in rehab the right to purchase a gun may be a violation of the Second Amendment. There’s actually a lawsuit over this in a federal court now and if the question on the gun form gets struck down, the prosecution’s case against Hunter collapses. The only thing they’ll have after the gun charges go away will be for him paying late on his taxes. This is some really weak shit for prosecutors.

So which side do gun zealots prefer? Going after Hunter on this rare gun charge and side AGAINST the Second Amendment and “right to bear arms,” or do they side with the Constitution? The law against drug users purchasing guns also applies to marijuana users. If you’re chillaxing with a gummy on a Saturday night and own a gun, you may be a criminal.

We do need tough gun laws, but we need to apply them equally. Prosecuting someone for lying on a federal form five years ago isn’t applying the law equally. Neither is investigating this for five years. The only reason Hunter Biden is being prosecuted for this is because his name is Hunter Biden.

Hunter Biden will not spend any time in prison. Do you know why? Because his dad is president. The only reason Hunter is being chased down for this is because his father is the president and Republicans think it’s a tit-for-tat for the prosecutions against Donald Trump, even though the crimes aren’t equal. Sure, Republicans will howl if Hunter doesn’t go to prison, but they’re already howling. Even if Hunter goes to prison, Republicans will find some reason to claim it’s not enoug punishment. President Joe Biden, fuck those Republicans. Pardon your son.

I don’t care how much Republicans scream, if I were in Joe Biden’s position, I would not let the goons have my kid because of my job. Give the prosecution an opportunity to fail and if somehow Hunter is convicted and sentenced, then pardon him. Trump pardoned a lot worse.

The case against Hunter is a bunch of bullshit anyway and a lot of those people doing the howling actually asked Trump for a pardon for their involvement in the January 6 white nationalist insurrection attempt.
