
I was in the process of doing something else when I thought of this, and I stopped working on the other cartoon to churn this out quickly. I’m still going to finish the first one I started. I haven’t decided if I’m going to send this to my clients or not. It’s not that I’m afraid of offending them. I’m more worried that they think I think this is passable for general newspapers. It’s not and most newspaper editors wouldn’t consider it. It’s shit like why I didn’t get the job in Minnesota. But, there are a few crazy alties out there with crazy editors who just might publish it. I’m looking at you, Detroit Metro Times.
I’m going to draw another cartoon on this subject, probably tomorrow. I’ll blog about the issue with that cartoon. For this one, let’s look at the fundamentalist judge who just banned abortion pills for most of the country. I’m going to use the word “fundamentalist” a lot in this blog.
Naturally, Judge Matthew Kacsmaryk is a Trump appointee. It took a few attempts to get him confirmed by the Senate but they really wanted this guy. During his confirmation process, he promised to apply the law as it’s written and would not insert his religious beliefs. Like all Trump nominees to federal courts, he lied. Isn’t it weird that these fundamentalist fucknuts strictly follow the Bible on everything except lying?
He’s a religious fundamentalist on a federal bench in Texas. The religious fundamentalist group that brought the case to his court was judge shopping. They relocated their organization to his district in order to get him, knowing he would do their bidding. What he did was ban mifepristone, an abortion pill, 23 years after the FDA approved it. Mifepristone is safer than Tylenol. It’s also safer than Viagra. At this point, I’m really fucking shocked that Viagra and Cialis aren’t being sold in vending machines. It’s not, is it?
Kacsmaryk is a religious fundamentalist. He graduated from Abilene Christian University. He was deputy general counsel for First Liberty Institute, a Christian fundamentalist legal organization that works to force its fundamentalist religious beliefs on the rest of the nation and restrict the rights of women. Any woman who disagrees with them is probably a slut. While working for First Liberty, he submitted an amicus brief to the Supreme Court arguing against a Washington state law mandating that pharmacies carry birth control.
He does put his money where his mouth is (he probably doesn’t put it where his wife’s mouth is) when it comes to birth control because he has five kids.
He’s a member of the Federalist Society, that fundamentalist fucknut group that selected all of Trump’s judicial appointments. He’s also a member of the Red Mass committee for the Roman Catholic Diocese of Ft. Worth.
In the past, he’s worked on cases opposing LGBT protections in housing, employment, and health care. He said people who are gay are “disordered.” He’s referred to being transgender as a “delusion” and a “mental disorder.”
He’s argued against same-sex marriage, civil rights protections for gay and transgender individuals, and the contraceptive mandate, and (surprise!), Roe v. Wade.
The abortion pill case isn’t the first instance of him being the judge in a case of judge shopping. In 2021, he ordered the reinstatement of Trump’s policy of forcing refugees to wait outside the United States while their claims are processed. It was overturned by the Supreme Court.
In November 2022, he ruled that President Biden can’t ban discrimination in Obamacare based on sexual orientation and gender identity.
Hew inserted his fundamentalist religious beliefs in his ruling against mifepristone. His rhetoric included, “Jurists often use the word ‘fetus’ to inaccurately identify unborn humans in unscientific ways. The word ‘fetus’ refers to a specific gestational stage of development, as opposed to the zygote, blastocyst, or embryo stages. … Because other jurists use the terms ‘unborn human’ or ‘unborn child’ interchangeably, and because both terms are inclusive of the multiple gestational stages relevant to the FDA Approval … this Court uses ‘unborn human’ or ‘unborn child’ terminology throughout this Order, as appropriate.”
He also mentions “the unborn humans extinguished by mifepristone” and “expelling the aborted human.”
And, he also mentions “fetal personhood,” the argument that the Constitution protects fetal life from the moment of conception bans states from allowing abortion. This shit reads like Gary Varvel wrote it.
Washington Post columnist Ruth Marcus wrote this weekend that Kacsmaryk is the worst federal judge in the United States. She describes him as a “true believer, miscast in a judicial role.”
Ruth Marcus is much more eloquent than I am but what she’s trying to say is that Judge Matthew Kacsmaryk is a fundamentalist fucknut.
